To gain feedback from Washingtonians, the Department of Labor & Industries (L&I) will hold six public hearings across the state to gather feedback on the draft overtime rules which would set a new salary threshold to 2.5 times the statewide minimum wage by 2026 and be adjusted annually.

FORMAT OF THE MEETING:
When you arrive to the meeting there will be a sign in to indicate if you would like to speak during the public hearing or not. The meeting will begin with a 1-hour overview of the Rulemaking on Minimum Wage Act Exemptions for Executive, Administrative and Professional (EAP) & Outside Sales Employees presented by L&I. During this briefing, you will get an overview of the law, learn about the history, criteria and background of the exemptions, an overview of the rulemaking timeline and an overview of the phase-in period. The public hearing will begin after the overview. Please prepare for a 2 minute or less time limit if you plan on speaking. You may also bring your comments in writing to submit following your testimony.
The Washington State Department of Labor & Industries is specifically looking for public input on the following:
- Alignment of language with federal tests (Salary Basis Test, Salary Level Test, Duties Test)
- Addition of clarifying definitions drawn from federal rules.
- The phase-in schedule for the overtime salary threshold (up to 2.5 times the Washington State minimum wage by 2026)
- How the draft rules and phase-in proposal will impact your business and your staff
