The ERISA Industry Committee (ERIC) Files HEHS Lawsuit Against Seattle

On Tuesday, The ERISA Industry Committee (ERIC) filed a lawsuit against the City of Seattle for Part 3 of the Hotel Employee Health and Safety Initiative (I-124) that details what type of health care coverage or compensation must be given to certain hotel employees. In their lawsuit, ERIC is arguing that by interpreting this section of the law, the City of Seattle is obstructing the federal law that enables large employers to administer health and retirement benefits uniformly across the country. Health benefit plans of large employers are regulated by the Employee Retirement Income Security Act (ERISA), which contains a broad federal preemption provision that invalidates any state or local law that relates to employee benefit plans, including health plans. Seattle Hotel Association Golf Tournament, Aug. 29
