Tip Pooling Update
As we notified you previously, at the end of 2016 restaurant employers were granted a 45-day extension to institute changes to mandatory tip pooling while decisions were made at the Supreme Court. We have faced a series of changes due to the current state of the U.S. administration and courts; deadlines went from Dec. 5, 2016, to Jan. 19, 2017, to March 17, 2017.
Today, the Supreme Court granted the U.S. Department of Labor’s (DOL) request for more time, so the DOL brief is now due May 11, 2017. You can see the full verbiage of the DOL petition to extend the deadline here. This means that the next deadline for us to be aware of is May 11. We will post any news prior to that date on this website.
Because the current federal regulatory environment is so fluid, the Washington Hospitality Association urges its members to consult our Tip Pooling page and continue to check back on our website for current information. We will keep you up-to-date with all the changes as they happen.
